Deft's motion for judgment as to pltff's negligence claim is GRANTED as to Icon's alleged negl igence in failing to obtain title insurance based on a lack of proximate cause and DENIED as to pltff's claim that deft was negligent in failing to record the deeds and mortgages associated with the subject properties. Mar 30, 2012 223 ORDER - Having considered Magistrate Judge Wall's R & R, Reskakis' objections and plaintiff's opposition to those objections, the undersigned adopts the R & R in its entirety for the reasons set forth therein. Accordingly, the Clerk o f the Court is directed to enter judgment against defendant Reskakis in favor of plaintiff FDIC, as Receiver for Am Trust Bank, in the sum of $7,811,516.40, to be offset by any funds received by the FDIC through foreclosure of the subject proper ties or monies received by other defendants. In the event the FDIC receives any such monies, it shall so notify both the Clerk of the Court and Reskakis, by first-class mail at his last known address. Ordered by Senior Judge Thomas C.
